Land privatization

Land privatization is a means to protect own property in case of a change of the legislation or any other circumstances. Why is privatization necessary?

By privatization, we mean the transition of the property to land from the state to a private person. Carrying out of this procedure will give you the opportunity to:

But it is worth mentioning that along with the rights, the owner acquires certain responsibilities: to pay taxes, to use the land only according to its intended purpose, not to violate the rights of other owners.

Land plots subject to privatization

In compliance with the norms of the Ukrainian legislation, one can obtain the ownership of the land that:

  • is in the use of the person on legal grounds (under the rent agreement, in long-term use, etc.);
  • is used to build a private house or setting a garden plot based on the documents issued to the applicant;
  • is in the public or communal property and can be transferred into private property.

The norms of the land privatization

Land legislation provides for the right of every citizen to get a free land plot. Obviously, this resource is limited, therefore there are certain norms in compliance with which land can be obtained free of charge:

  • to build a house – up to 0.25 ha in rural regions and up to 0.1 ha in the cities;
  • to build a country house – up to 0.1 ha in a co-op;
  • for gardening – up to 0.12 ha;
  • to build a garage – up to 0.01 ha;
  • to set a farming enterprise – within the average size establish for a particular region.

Every adult has the right to privatize each of the suggested options free of charge once.

Documents for the land privatization

Before carrying out the operation of interest, you need to make sure that you have all the necessary documents. That will require:

  • application;
  • passport and the personal taxpayer number of the applicant;
  • documents for the real estate objects, should there be ones on the land plot;
  • constitutional documents for legal persons;
  • graphic and technical documentation containing information about the location of the land plot and its boundaries;
  • data proving the use of the land on legal grounds.

Depending on the particular characteristics of every case, the other papers may be added to the abovementioned list.

The stages and the order of the land plot privatization

The procedure primarily depends on whether the land plot has been in the use of the person. Thus, should the applicant already possess the land, the algorithm of the actions will be as follows:

  1. Filing the application and the set of the documents with the city council or state administration by the location of the real estate;
  2. The authorized body has 30 days to make a decision;
  3. Given the positive decision, execution of the technical documentation takes place;
  4. Acquiring the documents on the property rights;

Let us note that even in the case of free privatization, it is necessary to pay the administrative fee for the execution of the documents.

Should you want to resort to your right to privatize the land you haven’t used yet, the mechanism of exercising it is slightly different:

  1. Submitting the application and other paperwork indicating the size of the land plot and its intended purpose with the city council or the state administration;
  2. Acquisition of the permit to design a land management plan;
  3. Coordination of the plan with the state commission;
  4. Carrying out of the normative and expert evaluation of the plot;
  5. Approval of the project;
  6. Execution of the technical documentation.
